These General Terms and Conditions of Sale and Use (hereinafter "T&C") govern the contractual relationship between ByteLogic LLC, a company incorporated under the laws of the United Arab Emirates, with its registered office at Compass Building, Al Shohada Road, AL Hamra Industrial, Ras Al Khaimah, United Arab Emirates, operating the BoxToPlay.com website (hereinafter "ByteLogic" or "we"), and any natural or legal person (hereinafter "the Client" or "you") subscribing to our hosting services.

BoxToPlay.com offers video game server hosting services (including Minecraft, BungeeCord, and other games to come) as well as Virtual Private Servers (VPS) for general or specialized use, with the possibility of evolving towards other hosting solutions (dedicated servers, containers, cloud). Our servers are located in Europe, the United States, and Canada, with the possibility for the client to choose the geographical location.

Any service order implies unreserved acceptance of these T&C. The Client declares having the legal capacity to contract (of legal age, i.e., 18 years or older). BoxToPlay.com services are intended for individuals as well as professionals, without distinction of treatment.

ByteLogic reserves the right to modify these T&C at any time. Modifications will take effect upon publication on the website. It is the Clients responsibility to regularly consult this page to become aware of any modifications.

Service(s): Refers to all hosting services offered by BoxToPlay.com, including without limitation game servers (Minecraft, BungeeCord, etc.), Virtual Private Servers (VPS), and any other hosting solution currently or subsequently offered.

Client: Any natural person of legal age (18 years or older) or legal entity having subscribed to one or more BoxToPlay.com Services.

Server: Virtual or physical machine made available to the Client as part of the subscribed Service.

Subscription: Monthly rental contract for a Service, tacitly renewable unless cancelled by the Client.

Control Panel: Web interface allowing the Client to manage their Service (start, stop, configuration, etc.).

VPS (Virtual Private Server): Virtual private server provided without pre-installed software, intended for general or specialized use according to the Clients needs.

Billing period: Monthly period corresponding to the duration of the Subscription, automatically renewable unless cancelled.

Following the validation of your order, BoxToPlay.com creates your server immediately. Your server is rented on a monthly basis (the minimum rental period is one month). The prices indicated are fixed, non-negotiable, and displayed including VAT at 20% (all taxes included). The final prices displayed on the site already include VAT.

Cancellation:
A subscription can be cancelled at any time by the client before the expiry date via the control panel or by contacting support. Cancellation will take effect at the end of the current billing period. The current subscription will not be refunded, except in the case of withdrawal rights described in Article 13.

The Client has a 14-day withdrawal period under the conditions specified in Article 13 (Withdrawal Rights).

ByteLogic is partnered with Paypal, Allopass, Stripe, and PaySafeCard to offer payment via credit card (CB, VISA, phone, etc..) or Paypal credit, thus providing a totally reliable and secure service.

In the event of an incident, ByteLogic only manages technical problems related to the basic installation of the service. Under no circumstances can BoxToPlay.com handle problems related to the operation or management of the service. Furthermore, BoxToPlay.com cannot be held responsible for errors occurring due to improper use of the service by the client.

BoxToPlay.com commits to providing an availability rate of 99.9% on a monthly basis for all its Services, excluding scheduled maintenance periods. This availability rate corresponds to a maximum downtime of 43 minutes per month.

Scheduled Maintenance:
ByteLogic reserves the right to perform maintenance operations necessary for the proper functioning of the infrastructure. When planned, these maintenances will be notified to Clients in advance via email or announcement on the website. ByteLogic strives to minimize the frequency and duration of these interventions.

Compensation for Downtime:
In case of cumulative downtime exceeding 24 consecutive hours during a billing period, due to a technical problem beyond ByteLogics control (hardware failure, infrastructure provider network issue), the Client may request compensation calculated on a pro-rata basis of the confirmed downtime, upon submission of a written request via the support ticket system within 7 days following the incident.

Compensation will be credited to the Clients account as credit usable for the next billing period. No other form of compensation (damages, loss of profit, data loss, etc.) may be claimed.

Exclusions:
The SLA does not apply in case of downtime due to: notified scheduled maintenance, force majeure, massive DDoS attacks, malfunctions caused by the Client (misconfiguration, voluntary overload), or interruptions requested by competent authorities.

Client Responsibility:
The Client is solely responsible for backing up their data, files, configurations, and content hosted on BoxToPlay.com Services. It is the Clients responsibility to implement their own backup strategy adapted to their needs and the importance of their data.

Automatic Backups (courtesy service):
BoxToPlay.com implements a daily automatic backup system for Services, with backup retention for 5 days. These backups are provided as a courtesy service and do not constitute a contractual obligation. The Client can restore their data directly from the control panel.

Available Restore Tools:
BoxToPlay.com provides restore tools accessible via the control panel, allowing the Client to restore their data from available automatic backups.

Limitation of Liability:
ByteLogic disclaims all responsibility in case of loss, corruption, destruction, or alteration of data, regardless of the cause (hardware failure, human error, cyber attack, force majeure, etc.). Automatic backups are provided without guarantee of integrity, completeness, or restorability. In case of automatic backup failure or inability to restore, no compensation may be claimed.

Recommendation:
It is strongly recommended that the Client perform regular backups of their critical data on external storage independent of BoxToPlay.com Services (local storage, third-party cloud, etc.).

In case of an interruption exceeding 24 consecutive hours due to a technical issue beyond our control (direct problem on our provider’s network, hardware issue of servers in the bays...), a refund of the ongoing subscription will be made on a pro-rata basis of the server’s downtime, in accordance with the provisions of Article 6 (Availability Guarantee - SLA). No other compensation of any kind will be possible. In all other cases, if ByteLogic desires, an exceptional commercial gesture may be discussed between ByteLogic and the client.

Available Support Channels:
BoxToPlay.com provides several channels to contact technical support:
Ticket System: Accessible from the control panel, preferred channel for any request requiring follow-up.
Discord: Community server for informal exchanges and peer-to-peer support.
Forum: Public platform for general questions, experience sharing, and community documentation.

Support Hours:
Technical support is available 7 days a week, from 9am to 10pm (Paris time, UTC+1/+2). Requests received outside these hours will be processed upon service reopening. Urgent cases related to total service unavailability may be handled outside business hours, without guarantee.

Support Scope:
BoxToPlay.com technical support exclusively covers:
• Infrastructure: server availability, network connectivity, control panel access.
• Hardware and network aspects: physical failures, bandwidth issues, connectivity.
• Account management: billing, renewal, subscription modification.

Application support (software configuration, Minecraft plugin installation, VPS application settings, custom development, etc.) is not covered by standard support. ByteLogic may, on an exceptional basis and without obligation, provide occasional assistance on simple application aspects, without resolution guarantee.

VPS Support:
VPS servers being unmanaged services, support is limited to infrastructure (access, connectivity, hardware performance). The Client is responsible for installing, configuring, and maintaining their software. Application assistance may be provided on an exceptional basis, without contractual commitment.

Documentation and FAQ:
BoxToPlay.com provides online documentation and an FAQ accessible from the website, covering frequently asked questions and common procedures. Clients are recommended to consult these resources before contacting support.

ByteLogic reserves the right at any time to modify or change the pricing of the service. The client may accept the change or refuse it and terminate his subscription. The client has no obligation regarding the renewal of the subscription and may at any time cancel his rental or decide not to renew it. BoxToPlay.com reserves the right to close the service without prior notice and terminate the client’s subscription without any possible refund if an infraction is observed by BoxToPlay.com such as using the service for purposes that represent any offenses punishable by French or international laws.

By subscribing to a service at BoxToPlay.com, the client acknowledges having read and accepted the general conditions of BoxToPlay.com as well as the various payment method options offered by BoxToPlay.com. The client also commits to complying with all applicable regulations regarding the dissemination of information on the Internet and to use the services offered by BoxToPlay.com properly without causing damage. The client is responsible for knowing how to use a server and cannot hold ByteLogic accountable if errors in handling occur that could harm the quality of the service.

Under penalty of definitive suspension without any refund, the client must not engage in the following:

- Outgoing DDoS attacks
- Email spamming
- Network port scanning

As well as any other actions prohibited by computer laws.

ByteLogic is committed to protecting the privacy of its users in accordance with applicable regulations, including the General Data Protection Regulation (GDPR) for European clients and applicable laws in other jurisdictions.

Confidentiality Commitment:
ByteLogic commits never to disclose, sell, or exchange your personal information to third parties for commercial reasons or for statistical purposes, except in cases of legal obligation or judicial requisition.

Analytics Tools and Cookies:
BoxToPlay.com uses third-party analytics tools, including Google Analytics, to collect anonymous statistical data about site usage (pages visited, session duration, etc.). These tools place cookies on your browser. You can refuse these cookies through your browser settings or our consent banner.

General Principle:
In accordance with applicable European consumer protection directives, the Client has a withdrawal period of fourteen (14) calendar days from the day the subscription begins, during which they may cancel their order and obtain a full refund of amounts paid, without having to justify their decision.

Condition for Exercising the Right of Withdrawal:
The right of withdrawal can only be exercised if the Client has not accessed, started, used, or configured the rented Service in any way during the withdrawal period. Any use of the Service (even minimal: connection to the control panel, server startup, file modification, configuration change, etc.) is considered express acceptance to waive the right of withdrawal, in accordance with applicable regulations.

Free Trials and Waiver of Withdrawal Right:
BoxToPlay.com offers free trial servers allowing the Client to test the Services without financial commitment before subscribing to a paid plan. Due to the availability of these free trials, the Client who subscribes to a paid Service and immediately starts using it expressly waives their right of withdrawal, having had the opportunity to test the service beforehand at no cost.

Withdrawal Procedure:
To exercise the right of withdrawal, the Client must notify ByteLogic of their decision before the expiry of the 14-day period, by sending a clear written request via the ticket system available in the control panel or by email to BoxToPlay.com support. Refund will be made within a maximum period of 14 days from receipt of the withdrawal request, using the same payment method used for the initial transaction.

Applicable Law:
These General Terms and Conditions of Sale and Use are governed by and interpreted in accordance with the laws of the United Arab Emirates, ByteLogic LLC being a company incorporated and registered under this jurisdiction.

Contractual Language:
In the event of a dispute, the version of the Terms & Conditions in the language used by the Client during subscription (French, English, or Spanish) shall prevail. If the Client has used the site in multiple languages, the language of the last validated order shall prevail.

Mandatory Amicable Resolution:
In the event of a dispute between the Client and ByteLogic concerning the interpretation, execution, or termination of these Terms & Conditions, the parties undertake to attempt to resolve the dispute amicably before any legal action.

The Client must notify the dispute in writing (email or registered letter) to BoxToPlay.com support, describing the nature of the disagreement and desired solutions. ByteLogic undertakes to respond within 15 business days and to propose an amicable solution within 30 calendar days from receipt of the notification.

If no amicable solution is found at the end of this 30-day period, each party is free to initiate legal proceedings in accordance with the provisions below.

Competent Jurisdiction:
In the event of failure of amicable resolution, any dispute relating to the interpretation or execution of these Terms & Conditions shall be submitted to the exclusive jurisdiction of the courts of Ras Al Khaimah, United Arab Emirates, to the exclusion of any other jurisdiction.

The Client expressly acknowledges this exclusive jurisdiction clause and waives any challenge to the jurisdiction of said courts. This clause applies to all disputes of a contractual or extra-contractual nature arising from these Terms & Conditions or in connection with the services provided by BoxToPlay.com.

Procedural Costs:
In the event of a dispute brought before the competent courts, the losing party shall bear all procedural costs, including the winning partys attorney fees, within reasonable limits and subject to the courts assessment.

General Principle:
BoxToPlay.com provides unlimited resources (bandwidth, CPU, RAM) for game servers to ensure optimal Client experience. However, these resources are shared in a mutualized environment and must be used reasonably and fairly in accordance with the Fair Use (acceptable use) principle.

Storage:
While CPU, RAM, and bandwidth resources are unlimited, storage space is limited by the subscribed plan. The Client agrees to respect the storage capacity allocated to their service. In case of exceeding the limit, BoxToPlay.com reserves the right to temporarily suspend the service until the Client frees up space or subscribes to a higher plan.

Normal Use of Game Servers:
Game servers provided are intended exclusively for hosting multiplayer games under normal gaming conditions. The Client is prohibited from diverting the server from its legitimate use for intensive activities unrelated to multiplayer gaming, including:
• Massive and continuous chunk generation (e.g., Chunky plugin on Minecraft) without connected players, solely for world pre-generation purposes.
• Running cryptocurrency mining plugins or software.
• Using the server as a distributed computing or data processing platform unrelated to gaming.
• Any other activity diverting game server resources from its primary objective: enabling players to play together.

Reasonable and temporary use of optimization plugins (limited pre-generation, maintenance) remains tolerated, provided it does not impact shared infrastructure performance and is part of normal game server usage.

Reasonable Use of Resources:
The Client agrees to use the provided resources reasonably and in accordance with normal game server usage. The following uses are considered abusive:
• Intensive and prolonged use of CPU/RAM resources causing performance degradation for other Clients.
• Excessive network traffic generation (excluding suffered DDoS attacks) disrupting shared infrastructure.
• Storing illegal content, content contrary to public morals, or violating intellectual property rights.

VPS (Virtual Private Servers):
VPS services are not subject to this Fair Use policy. Allocated resources (CPU, RAM, storage, bandwidth) are dedicated and guaranteed according to the subscribed plan. The Client has complete freedom of use within the limits of contracted resources and applicable laws.

Measures in Case of Abuse:
In case of abusive resource use detection (game servers only), ByteLogic reserves the right to:
• Contact the Client to identify the cause and propose solutions (optimization, migration to higher plan).
• Temporarily limit available resources to preserve infrastructure stability.
• Temporarily suspend the service in case of serious and repeated abuse, after prior notification.
• Terminate the service without notice or refund in case of fraudulent or illegal use.

Transparency:
ByteLogic commits to contacting the Client before any restrictive measure, except in case of absolute emergency (risk of widespread failure, proven illegal activity). The Client will be informed of the reasons for limitation or suspension and possible solutions to regularize the situation.

Platform Ownership:
All elements constituting the BoxToPlay.com website and associated services (control panel, administration interface, documentation, logos, trademarks, graphic charter, source code, databases, software architecture, etc.) are the exclusive property of ByteLogic LLC and are protected by intellectual property laws in force in the United Arab Emirates and internationally.

Panel Usage License:
ByteLogic grants the Client a non-exclusive, non-assignable, and non-transferable license to use the control panel and tools provided, solely within the normal use of subscribed Services. This license is strictly personal and automatically terminates upon service termination.

The Client expressly agrees not to:
• Copy, modify, adapt, translate, or create derivative works of the panel or any service component.
• Decompile, disassemble, or attempt to extract source code from provided software.
• Remove, hide, or modify intellectual property notices (logos, trademarks, copyrights).
• Use BoxToPlay.com or ByteLogic trademarks, logos, or graphic elements without prior written authorization.

Client Data Ownership:
The Client retains full ownership of their data, files, configurations, and content hosted on BoxToPlay.com Services. ByteLogic claims no intellectual property rights over Client content.

ByteLogic commits not to use, copy, modify, or disclose Client data to third parties, except:
• At the Clients express request.
• To ensure proper technical operation of Services (backups, migrations, maintenance).
• In case of legal obligation or judicial requisition.

Client Responsibility:
The Client guarantees holding all necessary rights to hosted content and commits not to store or distribute content infringing third-party intellectual property rights (pirated software, copyrighted content, etc.).

In case of third-party claims for intellectual property violation, the Client assumes sole responsibility and commits to defend and indemnify ByteLogic against any action, claim, or resulting damages.

BoxToPlay Trademark Use:
Any commercial or advertising use of "BoxToPlay", "ByteLogic" trademarks or their logos is strictly prohibited without prior written authorization from ByteLogic LLC.

Definition:
All external, unforeseeable, and irresistible events as defined by competent court jurisprudence, preventing ByteLogic from executing all or part of its contractual obligations, are considered cases of force majeure.

Examples of Force Majeure:
The following are considered force majeure cases, without this list being exhaustive:
• Natural disasters: earthquakes, floods, fires, storms, lightning.
• Armed conflicts, riots, acts of terrorism, states of emergency declared by authorities.
• Pandemics, epidemics, or major health crises declared by competent authorities.
• Major failures of telecommunications or energy networks not attributable to ByteLogic.
• Massive cyber attacks (DDoS exceeding protection capabilities, intrusions, ransomware) directly targeting ByteLogic or its providers infrastructure.
• Government or regulatory decisions imposing service suspension (censorship, requisition, prohibition).
• General strikes, transport or communication blockages on a national or international scale.
• Serious failure of a critical provider (datacenter, network operator, electricity supplier) independent of ByteLogics will.

Effects of Force Majeure:
In case of force majeure event occurrence, ByteLogic is exempt from all liability for non-performance or delay in executing its contractual obligations for the entire duration of the event.

ByteLogics obligations will be suspended during the force majeure period. No penalty, indemnity, or compensation may be claimed by the Client for damages resulting directly or indirectly from the force majeure event.

Notification and Duration:
ByteLogic commits to informing the Client as soon as possible of the occurrence of a force majeure case and its foreseeable duration, by any appropriate means (email, website announcement, social media).

If the force majeure situation persists beyond 30 consecutive days, each party may terminate the contract outright, without indemnity or penalty, by written notification to the other party. In this case, the Client will be refunded pro rata temporis for the unconsumed period, minus the force majeure period.

Service Resumption:
Upon cessation of the force majeure event, ByteLogic commits to resuming execution of its contractual obligations as soon as possible and informing the Client of effective service resumption.
